TERMS AND CONDITIONS
The use of this site is an agreement that you are subject to the following terms and conditions, and applicable law. You should take precautions when purchasing equipment of supplies from any website, but specifically as relates to this website. We (OnBuy Heating & Air Conditioning, Inc., “OnBuy”) offer sophisticated products that are typically not a “do it yourself” type of equipment. The installation, sizing, and proper utilization of such equipment, including without limitation, Air conditioning, and heating, is a skilled profession. Take all precautions when purchasing your equipment or supplies. Obtain reliable expert recommendations before you purchase. We offer advice about equipment solely based upon your representation(s) of your needs and assume that all patrons have invested the proper time and effort in determining proper sizing. We do not guarantee sizing or application other than described on the equipment, from the manufacturer. It is always recommended that you obtain local advice and be certain prior to your purchase. Improper selection and order of the wrong equipment or material shipped, that remains unpacked or opened, will be subject to a restocking/handling fee not to exceed 10%, less any shipping charges incurred by us. If you do not agree to these terms and conditions, please do not order from us.
Again, it is incumbent upon you, the customer to ensure the proper size and fit, including obtaining the proper advice from a local professional. PLEASE TAKE PRECAUTIONS IN ORDERING THE CORRECT PRODUCT FOR YOUR APPLICATION. We offer products based upon the premise that you have obtained the proper advice. We do not guarantee the sizing or application for your application. We highly recommend that you get local advice and be sure prior to your purchase. You will receive an email confirmation and a copy of your order. Please note, your order will begin processing the following business day. It is your responsibility to be sure your order is placed properly and that you ordered the correct equipment and supplies. Please notify us within 24 hours if anything is incorrect so that we may stop shipment and correct your order. If your order has been shipped or been picked up, we have incurred expenses that cannot any longer be waived, and you will be responsible for all costs associated with correcting your order.
We are proud to accept Master Card, VISA, Discover, PayPal, Wire Transfer, Company Check (with confirmation of clear from your bank) or Money Orders. Due to fraud upon customers, as well as merchants, Cashier’s Check, and personal checks must be cleared prior to shipment. If you must use a Cashier’s Check or personal check, please contact us in advance to determine if we can escrow the same.
CANCELLATIONS OR REVISIONS TO ORDER
If your order has not shipped or been picked up, we will refund 97% of your payment if paid by credit card, Debit card, PayPal. Wire transfers will include those transfer fees (typically $15.00 incoming, and $25 outgoing). The is no fee for a refund by our Company Check.
If your order has not been shipped or picked up, and you wish to change said order, there will a 100% application of your payment to your revised order. Any portion that is a refund will be subject to the foregoing.
If your order has been shipped or picked up and you have not unpacked or opened your order, we will refund 90% less any shipping charges incurred to and from your destination.
If you have received your order and opened it, and it cannot be returned in the original condition as shipped, we will refund upon receipt and inspection an amount that is fair and equitable to both parties.
Installed equipment or parts are not refundable.
After payment is received, your order will be processed within 2-3 business days. Your order will be shipped by the following means. If the order is over 100 pounds, we will ship on a trucking line strapped to a pallet and shrink-wrapped for the safety of your order. Please allow 7 to 10 days to arrive. Items under 100 pounds will be sent UPS or FedEx please allow 5 days to arrive.
It is our policy and the trucking company’s policy to tell you to allow 7 to 10 days for delivery, but in most cases, it will arrive sooner. The trucking company will not be able to tell you where the shipment is in transit. Further, we will not be able to advise you on where in transit your shipment is located. In the unlikely event, your shipment is late contact our office at 866-446-6289.
If your shipment is going to a business address, a semi-truck will require access to the business. Said business should have a loading dock other than in a residential area or a terminal address. You will be responsible for any additional charges if misinformation is given.
If your shipment is going to the trucking company distribution center, they will call you when the shipment arrives. Your system in most cases will fit in a small pickup truck, SUV or van.
If your shipment is going to a residential address, it is vital that you are present when shipment arrives, or your delivery will be delayed outside of our control. The Trucking Company will call you before delivery.
Regardless of which type of shipping you chose, it is important that you open or removes the box and inspect all equipment pieces you purchased from us. We take every precaution to package your items properly for shipment. And, despite how often we plead with carriers to be gentle with our customers’ orders. it is possible that small dents or dings to the cabinets could be found. In this situation, you should notate the damage on the trucking company delivery receipt and accept the shipment. Cosmetic damage or minor flaws that can be deemed cosmetic if they do not affect the operation of the system or warranty. In the event that major damage is evident, IT IS VERY IMPORTANT TO NOTE SAID DAMAGE on the trucking company delivery receipt and refuse the shipment.
In the unlikely event your order is damaged, or items are missing and you have properly notated on the trucking company delivery receipt, the items will be reshipped to you as soon as possible at no additional charge. A damaged shipment is not grounds for canceling your order. It is the policy to reship your replacement item(s) provided you have properly notated the damage or missing items as outlined above. Notwithstanding, if you do not want to wait for your replacement, you will be subject to the cancellation policy.
IMPORTANT READ THE BELOW STATEMENT
IF YOU OR SOMEONE ELSE ON YOUR BEHALF ACCEPTS THE DELIVERY WITH NO DAMAGE OR MISSING ITEMS NOTATED, OR YOU DO NOT INSPECT ALL EQUIPMENT, PARTS OR SUPPLIES AND DAMAGE IS FOUND LATER YOU WILL NOT BE ABLE TO MAKE A CLAIM THROUGH ONBUY. UNFORTUNATELY, WE WILL NOT BE ABLE TO HELP YOU, AND WE WILL BE UNABLE TO SHIP YOU ANOTHER UNIT OR INTERVENE WITH THE TRUCKING COMPANY.
IT MAY BE POSSIBLE THAT YOU CAN FILE A CLAIM ON YOUR OWN BEHALF DIRECT WITH THE TRUCKING COMPANY.
It is your responsibility to thoroughly inspect your shipment to be sure it is complete and correct.
If your order is incorrect, we must be notified within 48 hours, otherwise, your purchase will be deemed completed, and closed out.
If your order is accepted and signed for, it is deemed correct. If you find afterward that your order is incorrect, you will be responsible for inbound and outbound freight to correct the order.
As stated above, it is strongly recommended that you have the system installed by a knowledgeable professional. Regardless of who installs your equipment, it must be charged and started by a licensed company or individual. NEVER RELEASE REFRIGERANTS INTO THE ATMOSPHERE. It is not necessary or cost-effective no matter what anyone states to the contrary.
It is your responsibility to be sure your equipment and supplies purchased from OnBuy conform to local, state, federal, or Canadian codes. All installations must follow EPA regulations governing the handling of refrigerant. OnBuy assumes no liability associated with the installation of your equipment.
OnBuy will accept returns of equipment, supplies, and parts if returned within 14 days of purchase. Subject to the following conditions:
- Items must be returned in the same condition as shipped at purchaser’s expense for freight
- We do not accept returns for electrical parts
- Items must be received before refund is issued
- We will not accept returns of installed equipment or parts
- A 10% restocking fee will be assessed for the order amount of returned items.
- If the item or items returned were shipped the cost of the freight will be deducted from your refund
All manufactures warranties apply based on brand and equipment. OnBuy offers no labor warranty, as we are not installing your equipment. Your local contractor should supply you with a labor warranty. Your local company can replace any parts under warranty. OnBuy will handle the parts exchange for you, a small processing fee may apply plus UPS or FedEx charges. You may also choose to have your local air conditioning company process the warranty directly with the manufacturer of the equipment, your warranty is through the manufacturer NOT OnBuy, however, we will assist.
EXPEDITED PARTS WARRANTY
As a courtesy OnBuy will allow a customer to pay for the cost of the new part prior to receiving the defective one back. When we receive the defective part, a credit will be issued for the cost of the part paid upfront.

If this were to happen, OnBuy would contact you within 24 hours and attempt to resolve the discrepancy. OnBuy reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, OnBuy shall issue a credit to your credit card account in the amount of the incorrect price. There will be no fees or charges for refunds under an incorrect price.
TERMINATION AT WILL
These terms and conditions are applicable to you upon your accessing the site. These terms and conditions, or any part of them, may be terminated by OnBuy without notice at any time, for any reason. It is intended that provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, survive any such termination.

Your use of this site shall be governed in all respects by the laws of the state of Florida, U.S.A., without regard to the choice of law. You agree that the jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of OnBuy products) shall be in the state or federal courts located in Hillsborough County, Florida. You agree to indemnify, defend, and hold harmless OnBuy, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your account.
OnBuy may link to sites operated by third parties. OnBuy has no control over these linked sites if any. Each must be assumed to have separate privacy and data collection practices, independent of OnBuy. Nonetheless, OnBuy would still request your feedback on this site as well as others that it believes may be helpful to you. If, for any reason you do not find it helpful, please let us know.
